TERMS AND CONDITIONS OF SALE, DELIVERY AND PAYMENT
1. General
All our deliveries and services shall be carried out exclusively on the basis of these General Terms and Conditions. Deviating conditions of the Buyer require our consent. We supply exclusively for commercial use. Excess or short deliveries of up to 10% are sometimes unavoidable for promotional items and shall be deemed to have been agreed. However, delivery of an exact number of units is the norm.
2. Quotations
Our quotations shall always be non-binding and subject to availability. Orders shall be deemed accepted when we send you an order confirmation or deliver the ordered goods. We reserve the right to deliver our articles only in commercial quantities.
3. Pictures and description of products
Depicted decoration items are not included in the scope of delivery. Technical modifications as well as changes in form, colour and material are reserved. We reserve the right to effect minor deviations from the product image. Information on weight, dimensions, capacity, performance, colour etc. are only indications.
4. Prices
All prices are net prices carriage forward, ex works and include statutory VAT. We reserve the right to effect price corrections in the event of exceptional fluctuations in commodity and currency prices. Current daily prices can be found at www.bettmer.de.
5. Advertising
In the event of an absence of information concerning size, condition and colour, we reserve the right to undertake the advertising in line with what is appropriate for the article. Only the proofs made by us are binding, however, exemplary illustrations in the catalogue and in the online shop are not.
6. Shipping costs
We charge the following flat rates per order for shipping by parcel service and packaging:
Order value below €50.00 = €4.95
Order value from €50.00 = €9.95
Order value from €250.00 = €12.95
We charge a freight surcharge of €20.00 for particularly large-volume or bulky shipments.
7. Delivery
We usually deliver items without advertising at short notice within a few days. Items with advertising are generally available for delivery within 3-4 weeks. Partial deliveries will be avoided if possible, but we reserve the right to make them. Payment for previous partial deliveries cannot be withheld under our terms of payment due to pending quantities. The delivery week confirmed by us is an expected delivery date and applies to delivery ex works. Fixed dates shall only become valid after our express written confirmation. In the event of a delivery delay due to negligence, claims for compensation shall be limited to the amount of the price difference for the replacement purchase. Additional claims for damages are excluded.
8. Right to return unsatisfactory items
If an item does not meet your expectations, you can return it within 20 days. This is conditional upon your returning the goods to us unused and in perfect condition in the original packaging. Please understand that articles with individual printed advertising are excluded from the right to return unsatisfactory items. Your legal warranty claims shall naturally continue to exist with respect to these articles.
9. Payment
Within 20 days net, without discount. Delivered goods shall remain our property until full payment.
10. Warranty
Statutory warranty claims shall apply.
11. Data Protection
In principle, personal data shall be processed in accordance with data protection regulations. Your data shall be processed to conduct the transaction on the basis of Article 6(1)(b) GDPR. In addition, we shall process your personal data on the basis of Article 6(1)(f) GDPR for promotional purposes, in particular to send you interesting information and offers from us and other companies. Batteries shall not be disposed of with household waste. All end users are required by law to return used batteries to a collection point (anywhere in the trade where the respective batteries are sold or at public collection points). You can also return batteries that we sell to us in quantities customary for end users with sufficient postage. The pollutants in batteries are identified as follows: Pb stands for lead, Cd for cadmium and Hg for mercury.
